Premessa

Il concorso online per la nuova sistemazione di Piazza Matteotti è parte del progetto SCANDICCI CITTÀ SPERIMENTALE. Tale progetto è nato per offrire alla città di Scandicci un website configurato come uno strumento di interazione tra Amministrazione Comunale, progettisti, creativi e cittadini, per dotarla di un sistema dinamico di visualizzazione dei processi progettuali finalizzati allo sviluppo della nuova città negli anni a venire. Tra le finalità principali del progetto, la promozione su scala internazionale delle risorse artistiche, economiche e produttive del territorio, dell'architettura e dei servizi disponibili, la valorizzazione attraverso la rete delle specifiche identità del Comune di Scandicci, favorendo le possibilità di comunicazione e di attivazione progettuale e ideativa che la particolare collocazione geografica e culturale del territorio consente, rispondendo alle dinamiche della società e della città contemporanea. Con il concorso per la nuova sistemazione di Piazza Matteotti, Scandicci inaugura e sperimenta una pratica concorsuale originale, che tende a mettere a frutto le potenzialità del sistema online: dalla fase di lancio del bando alla gestione delle proposte, all'intervento della commissione giudicatrice, alla pubblicazione dei risultati. Oltre alla semplificazione delle procedure tradizionali il concorso online integra ed estende le possibilità di coinvolgimento e di diffusione. In questo senso, e come prima fase del progetto SCANDICCI CITTÀ SPERIMENTALE, la struttura allestita in occasione del concorso fornisce una prima importante occasione di riflessione progettuale sulla trasformazione dello spazio urbano del Comune di Scandicci.



art. 1 - Tipologia di concorso

L'Amministrazione Comunale di Scandicci bandisce un concorso di idee, a livello Internazionale Europeo ed in forma palese. Il concorso è previsto in tre sezioni o A) La prima aperta a tutti i progettisti in possesso dei requisiti di cui al successivo art. 4; o B) La seconda aperta agli studenti europei e di tutto il mondo di ogni ordine e grado; o C) La terza agli artisti ed operatori della cultura di tutto il mondo

Il concorso si svolgerà in un'unica fase e si concluderà con la premiazione dei vincitori e segnalati.



art. 2 - Scopo e temi del concorso

Il concorso è bandito ai fini di rendere disponibile per la Città di Scandicci la migliore idea di assetto e riqualificazione ambientale dell'area di piazza Matteotti che rispetti le seguenti indicazioni: o fermo restando la piena libertà progettuale e di espressione delle idee, l'area progettuale è quella compresa all'interno del sistema perimetrale viario, composto di carreggiate stradali, parcheggi, marciapiedi ; o Il sistema viario perimetrale può essere oggetto di riordino; o Il monumento esistente al centro della piazza può essere ricollocato o soppresso e sostituito con altro elemento simbolico; o Gli arredi e i componenti impiantistici luminosi debbono essere a basso inquinamento luminoso; o Il sistema degli impianti arborei esistenti è elemento di vincolo conservativo, rispetto al quale si possono effettuare proposte di recupero ed integrazione o L'importo presunto di spesa è di lire un miliardo ( euro 516.457 )



SEZIONE A

art. 3 - Documentazione riguardante il luogo e l'elaborazione del progetto

Costituiscono parte integrante del bando di concorso i seguenti materiali che saranno disponibili sulla rete e che faranno da linee guida per tutti i partecipanti: allegato 1, Linee-guida contenenti la descrizione delle caratteristiche, delle funzioni e del sistema dei requisiti dell'area; allegato 2, Materiali di base per l'esecuzione degli elaborati di concorso, riportante l'orientamento e la perimetrazione dell'area al cui interno si devono realizzare gli interventi.

Resta inteso che l'area oggetto del concorso comprende esclusivamente il sedime pubblico pavimentabile, con esclusione degli edifici che su di esso insistono o che lo racchiudono, avente come ambito l'area di piazza Matteotti.

Altre informazioni sono contenute nei materiali di cui al punto 1. Gli elaborati grafici sono tutti in formato digitale di dimensione 800x600 pixels e saranno restituiti da tutti i partecipanti completati con l'idea proposta.

E' vietato - pena l'esclusione- presentare elaborati aggiuntivi o di formato differente da quello richiesto.



art. 4 - Condizioni di partecipazione

La partecipazione al concorso è aperta agli architetti e agli ingegneri iscritti agli Albi dei rispettivi Ordini professionali sul territorio nazionale, nonché ai progettisti legalmente abilitati e iscritti alle rispettive categorie o associazioni nell'ambito dell'Unione Europea, ai quali non sia inibito al momento dell'iscrizione al concorso l'esercizio della libera professione, sia per legge, sia per contratto, sia per provvedimento professionale, fatte salve le incompatibilità di cui all'art. 5 del bando.

La partecipazione può essere individuale o di gruppo; nel secondo caso tutti i componenti del gruppo devono essere in possesso dei requisiti di cui al comma precedente del presente articolo.

Ad ogni effetto del presente concorso un gruppo di concorrenti avrà, collettivamente, gli stessi diritti di un singolo concorrente.

Ogni gruppo dovrà nominare un suo componente, quale delegato paritetico a rappresentarlo come capogruppo presso l'ente banditore, che dovrà essere indicato al momento dell'iscrizione, come meglio specificato al successivo art. 8.

A tutti i componenti del gruppo è riconosciuta, a parità di titoli e diritti, la paternità delle proposte o del progetto concorrente.

Al concorrente singolo o ai concorrenti in gruppo è consentito di avvalersi di consulenti o di collaboratori, che potranno essere privi dell'iscrizione agli Albi di cui al precedente primo comma del presente articolo, ma non dovranno trovarsi nelle condizioni di incompatibilità di cui al successivo art. 5 e non potranno essere componenti del gruppo.

I loro compiti ed attribuzioni saranno definiti all'interno del gruppo concorrente senza investire del loro rapporto l'Ente banditore, al quale dovrà essere comunque dichiarata la qualifica e la natura della loro consulenza o collaborazione.



art. 5 - Incompatibilità dei partecipanti

Non possono partecipare al concorso: o i componenti la giuria, i loro coniugi, i loro parenti ed affini fino al terzo grado compreso; o gli amministratori ed i consiglieri dell'Ente banditore; o i datori di lavoro o coloro che abbiano qualsiasi rapporto di lavoro o di collaborazione continuativo e notorio con membri della giuria; o coloro che hanno partecipato alla stesura del bando o coloro che hanno rapporti di lavoro dipendente a tempo pieno con l'Ente banditore e con Enti, Istituzioni o Amministrazioni pubbliche, che per fini istituzionali abbiano compiti di indirizzo o controllo sulla materia del bando.



art. 6 - Incompatibilità dei giurati

Non possono far parte della giuria: o i concorrenti, i loro coniugi, i loro parenti ed affini fino al terzo grado compreso o i datori di lavoro e i dipendenti dei concorrenti o coloro che con essi abbiano qualsiasi rapporto di lavoro o di collaborazione continuativo e notorio.

Non possono inoltre far parte contemporaneamente della giuria: o parenti ed affini fino al terzo grado compreso; o datori di lavoro e loro dipendenti; o coloro tra i quali intercorre qualsiasi rapporto di lavoro o di collaborazione continuativo e notorio.



art. 7 - Elaborati da presentare al concorso

Il numero e le dimensioni degli elaborati di progetto sono fissi e immodificabili; non sono ammessi elaborati in più o in meno o diversi di quelli appresso indicati.ù

Le lingue ufficiali con cui dovranno essere illustrati gli elaborati progettuali sono l'italiano e l'inglese.

Gli elaborati dovranno essere inviati via email ed in forma palese.

Le proposte progettuali e le schede verranno contrassegnate in fase di accettazione dall'Ente banditore, con un numero progressivo relativo al numero di protocollo corrispondente all'ordine di arrivo; pertanto non dovrà essere riportato nessun tipo di motto o di codice alfanumerico sugli elaborati o sulla scheda presentati. Il numero assegnato verrà comunicato ai partecipanti attraverso una email che testimonierà l'avvenuta accettazione della proposta.

Le idee e le proposte progettuali dovranno essere rappresentate dai concorrenti sulle basi fornite dell'Ente Banditore e restituite in formato digitale nei seguenti elaborati:
· n. 1 immagine della dimensione di 800x600 pixel in formato GIF / JPG contenente le indicazioni urbanistiche in una planimetria in scala 1:2000.
· n. 1 immagine della dimensione di 800x600 pixel in formato GIF / JPG contenente una pianta della piazza in scala 1:200.
· n. 1 immagine della dimensione di 800x600 pixel in formato GIF / JPG contenente sezioni della piazza in scala 1:200.
· n. 1 immagine della dimensione di 800x600 pixel in formato GIF / JPG contenente una rappresentazione libera della soluzione proposta.
· n. 1 documento di testo (in formato DOC o RTF) consistente in un massimo di 15.000 battute (circa 10 cartelle di testo) di descrizione dei criteri progettuali adottati, delle soluzioni proposte, della giustificazione della realizzabilità del progetto e delle scelte tecnico-costruttive.

art. 8 - Modalità di iscrizione

L'iscrizione al concorso coincide con la consegna degli elaborati e il pagamento - per i partecipanti alla sezione A - della quota di iscrizione di lire 100,000 (pari a 51,64 Euro) secondo le modalità indicate.

L'iscrizione e la consegna degli elaborati dovrà essere effettuata entro il sessantesimo giorno dalla pubblicazione del bando sulla Gazzetta ufficiale della Comunità europea e dovrà pervenire via email all'indirizzo concorso-a@bitcity.it.

Non è ammessa la consegna a mano e non saranno ammesse domande e consegna degli elaborati pervenute oltre tale termine.

Alla domanda dovrà essere allegata la scheda da compilare contenente: o nome, cognome, data di nascita e cittadinanza; o domicilio e recapito telefonico di riferimento; o eventuale recapito fax e indirizzo di posta elettronica; o gli estremi dell'iscrizione all'Ordine professionale di appartenenza (esclusi i collaboratori ed i consulenti); o il delegato designato come capogruppo in caso di raggruppamento; o qualifiche accademiche e professionali; o dichiarazione di non sussistenza delle inibizioni all'esercizio professionale contemplate all' art. 4 o delle incompatibilità di cui all' art. 5; o dichiarazione da parte di eventuali consulenti o collaboratori riguardante la qualifica e la natura delle prestazioni svolte. o per professionisti concorrenti che provengono dai paesi dell'Unione Europea dovranno presentare un' autodichiarazione, resa ai sensi della Direttiva 85/384 CEE, recepita con decreto legislativo n. 129 del 27 gennaio 1992. o per dipendenti a tempo pieno di enti, istituzioni o amministrazioni pubbliche la dichiarazione di essere in possesso dell'autorizzazione, prodotta e sottoscritta dal loro datore di lavoro, a partecipare al concorso. Dichiarazione avente data precedente alla consegna degli elaborati che dovranno produrre - pena l'esclusione - nel caso che l'idea presentata risultasse fra quelle premiate o segnalate. o l'esplicita dichiarazione che il concorrente, singolo o in gruppo, non si avvarrà del diritto di anonimato durante l'esposizione dei progetti.

art. 9 - Calendario e procedure

L'Ente banditore fino al termine del periodo previsto per l'iscrizione metterà a disposizione sul sito http:/scandicci.bitcity.it il materiale documentario, del concorso.

I concorrenti, nei quaranta giorni successivi alla pubblicazione del bando sulla Gazzetta ufficiale della Comunità europea, potranno presentare quesiti all'indirizzo email info@bitcity.it

3
Le risposte saranno fornite dall'Ente banditore in forma palese sullo stesso sito a tutti i concorrenti nei sette giorni seguenti, con le stesse modalità di ricevimento.

4
Alla scadenza del sessantesimo giorno successivo alla data di pubblicazione sulla Gazzetta ufficiale della Comunità europea, entro le ore 24 (ora italiana), gli elaborati dovranno pervenire all'indirizzo email concorso-a@bitcity.it

Saranno esclusi tutti gli elaborati pervenuti oltre il suddetto termine.

I risultati definitivi del concorso saranno pubblicati sul sito http://scandicci.bitcity.it e saranno comunicati al Consiglio Nazionale degli Architetti, al Consiglio Nazionale degli Ingegneri ed agli Ordini professionali territorialmente interessati.

Le scadenze concorsuali sopra specificate sono riassunte nel sottostante riepilogo, tenendo conto che eventuali variazioni saranno tempestivamente comunicate sul sito http://scandicci.bitcity.it. scadenze e tempi previsti: o presentazione quesiti: 40 giorni dalla pubblicazione sulla GUCE (8 agosto 2000) o risposte ai quesiti: entro 7 giorni dal termine per la presentazione di quesiti o iscrizione e consegna elaborati: entro 60 giorni (28 agosto 2000) dalla pubblicazione sulla GUCE



art. 10 - Composizione e funzionamento degli organi giudicanti

Per tutte e tre le sezioni del bando è nominata dall'Ente banditore una Commissione tecnica, con il compito istruttorio di verificare, dopo la scadenza del termine per la consegna degli elaborati, che il materiale risulti pervenuto nei tempi e nei modi fissati nel bando e che gli elaborati siano conformi a quelli richiesti e con compiti di segreteria per il funzionamento della giuria.

A seguito dell'esame istruttorio svolto la Commissione tecnica fornirà l'elenco dei concorrenti non meritevoli di ammissione, con le motivazioni della loro possibile esclusione e compilerà inoltre in base All'ordine di arrivo la lista dei partecipanti secondo la quale gli elaborati inviati dovranno essere esaminati dalla giuria.

Per tutte e tre le sezioni del bando è nominata una Giuria esaminatrice comprendente un numero dispari di membri, con lo scopo di esaminare e valutare gli elaborati selezionati e di individuare il vincitore, che sarà unico, non essendo prevista una situazione di parità.

La Giuria dovrà contare, nella sua composizione, su una maggioranza di tecnici quali membri effettivi, con altrettanti membri supplenti, scelti tra progettisti esperti del settore, o che abbiano già svolto compiti di giurato in concorsi di pari importanza o vi abbiano partecipato conseguendo un premio.

La Giuria sarà composta dai seguenti sette giurati effettivi con diritto di voto e da altrettanti supplenti: o n. 5 esperti effettivi e n. 5 supplenti nominati dall'Ente banditore o n. 1 rappresentante effettivo e n. 1 supplente nominato dal Consiglio Nazionale degli Architetti o n. 1 rappresentante effettivo e n. 1 supplente nominato dal Consiglio Nazionale degli Ingegneri 6 Le riunioni della Giuria relativamente alla nomina dei vincitori saranno valide solo con la presenza dei 7 giurati.

Quando un membro effettivo è assente, per sopravvenuta impossibilità o qualsiasi altro motivo di cui deve dare comunicazione all'Ente banditore almeno tre giorni prima della seduta, decade ed è sostituito dal corrispondente giurato supplente o, in caso di sua indisponibilità, da un altro dei supplenti.

Fungerà da segretario senza diritto di voto un componente della commissione tecnica che potrà essere coadiuvato da incaricati di segreteria, con il compito di redigere il verbale delle sedute e di comunicare risultati, criteri, valutazioni e motivazioni delle scelte agli Ordini territorialmente competenti.

Il presidente della Giuria sarà eletto da tutti i suoi componenti alla prima riunione, tra i membri effettivi nominati dall'Ente banditore.

I componenti la Giuria non potranno ricevere, dall'Ente banditore o da chi subentrasse nelle sue funzioni successivamente all'espletamento del concorso, incarichi di progettazione o di consulenza per la progettazione inerenti l'oggetto del concorso, sia singolarmente sia come componenti di un gruppo.

A ciascuno dei membri della Giuria, per la partecipazione alle tre sezioni, sarà corrisposto un gettone onnicomprensivo di presenza e di rimborso spese di £. 900.000 Euro 465 (di £. 1.800.000 Euro 930 a quelli con residenza abituale ubicata ad una distanza di oltre 400 Km dalla sede del concorso) al lordo della ritenuta d'acconto ed al netto di IVA ed oneri previdenziali.

I membri della Commissione tecnica e della Giuria, con i relativi membri supplenti, saranno nominati e resi pubblici sino dalla pubblicazione del bando, al fine della valutazione di eventuali incompatibilità.



art. 11 - Lavori della Giuria

1
La Giuria, convocata con almeno 15 giorni di preavviso, dovrà iniziare i propri lavori comunque entro 10 giorni dalla data di scadenza per la consegna degli elaborati da parte dei concorrenti.

Nel caso in cui non si potesse riunire o non concludesse i lavori nei termini stabiliti, verrà distribuito in misura uguale tra tutti i partecipanti, la cui iscrizione sia stata giudicata regolare dalla Commissione tecnica, il 50% dei montepremi complessivo.

Ogni giurato disporrà di un voto, le decisioni verranno prese a maggioranza e saranno inappellabili.

La giuria redige la relazione contenente la valutazione delle idee premiate e segnalate con le relative motivazioni, la descrizione della metodologia seguita dai commissari per la loro valutazione e l'iter del lavoro svolto, e sarà resa pubblica con la nomina dei vincitori.

Formata la graduatoria finale la Giuria definirà l'assegnazione dei premi, fermo restando che il primo premio potrebbe non essere assegnato qualora all'unanimità i membri non ritenessero alcun progetto meritevole di tale conferimento.

Graduatoria definitiva, elenco di tutti i partecipanti e relazione conclusiva della Giuria saranno resi pubblici sul sito ed inviati ai Consigli Nazionali degli Architetti e degli Ingegneri ed agli Ordini professionali territorialmente competenti.



art. 12 - Esito del concorso e premi

Il concorso si concluderà con una graduatoria di merito ed i premi (al lordo della ritenuta d'acconto ed al netto di IVA ed oneri previdenziali) saranno assegnati come segue: - un importo di £. 5.000.000 (cinque milioni di lire) Euro 2582 al progetto vincitore; - un importo di £. 3.000.000 (tre milioni di lire) Euro 1549 al progetto secondo classificato - un importo di £. 1.500.000 (unmilionecinquecentomila lire) Euro 775 al progetto terzo classificato La giuria avrà a disposizione inoltre la possibilità di n. 10 segnalazioni.

L'Ente Banditore, nel caso di risorse aggiuntive, derivanti dai proventi delle iscrizioni o da sponsorizzazioni, si riserva la facoltà di elevare proporzionalmente l'importo dei premi e di fornire alla giuria un monte premi per le segnalazioni.

Il premio corrisposto all'idea giudicata migliore è da considerarsi come anticipo sui compensi che dovranno essere riconosciuti al suo estensore, in caso di affidamento dell'incarico o della consulenza per il progetto definitivo-esecutivo, come meglio specificato nel successivo art. 13.



art. 13 - Esecuzione dell'opera

L'Ente banditore, o una stazione appaltante che gli subentri, si riservano la facoltà di realizzare l'opera oggetto del concorso. 2 Nel caso che l'opera venga realizzata, l'incarico per la redazione del progetto definitivo ed esecutivo (o la consulenza nel caso si utilizzino strutture tecniche interne all'amministrazione) verrà comunque affidato all'estensore del progetto vincitore, che dovrà redigerlo secondo le indicazioni e le richieste dell'Ente banditore, il quale potrà richiedere l'introduzione di modifiche e perfezionamenti anche introducendo le idee dei vincitori delle sezioni B e C del presente concorso, senza che ciò comporti ulteriore compenso oltre a quanto stabilito per la stesura di tale progetto. 3 L'Ente banditore o l'ente ad esso eventualmente subentrante avranno facoltà di affidare il coordinamento della sicurezza per l'esecuzione delle opere (di cui alla legge 494/1996), come pure la direzione dei lavori oggetto del presente concorso a soggetti diversi dal vincitore, individuati attraverso i procedimenti di selezione consentiti dalla vigente normativa sui lavori pubblici, senza obbligo di compenso aggiuntivo da corrispondere all'estensore del progetto definitivo-esecutivo, salvo quello spettante per la direzione artistica dei lavori o consulenza, che resterà comunque di sua competenza. 4 I compensi saranno determinati in conformità alle tariffe professionali ed ai regolamenti in materia vigenti al momento del conferimento dell'incarico; su di essi verrà praticata la riduzione dell'importo, nella misura del 20%, consentita dalla legge 155/1989.



art. 14 - Pubblicizzazione dei progetti

I progetti - organizzati con la classificazione proposta dalla giuria - provvederà, con modi e tempi da stabilire, ma comunque entro 30 giorni dalla proclamazione dei vincitori del concorso, ad organizzare sul sito del concorso una mostra di tutti gli elaborati presentati, e uno spazio per un forum pubblico online al quale sono invitati a prendere parte gli estensori dei progetti premiati e non, per continuare ad illustrare pubblicamente le loro idee e proposte progettuali.

I partecipanti possono richiedere - al momento dell'iscrizione/invio degli elaborati - di non pubblicare sulla rete i propri elaborati. Tale richiesta non potrà essere accolta dall'Ente banditore (pena la rinuncia da parte dei concorrenti con relativa esclusione) nell'eventualità i progetti risultassero premiati o segnalati.

L'ente banditore si riserva l'opportunità di pubblicare i risultati del concorso in forma cartacea o altre procedure.



art. 15 - Regolarità del bando e dispute

Il presente bando è stato redatto in conformità alle indicazioni fornite dal Consiglio Nazionale degli Architetti e dal Consiglio Nazionale degli Ingegneri, ai quali è stato preliminarmente sottoposto ai fini dell'approvazione.

E' stato inoltre trasmesso agli organismi rappresentativi interessati, con l'invito a pubblicizzarlo direttamente ai propri iscritti.

Ogni eventuale disputa riguardante le procedure della competizione sarà affidata alla valutazione dell'autorità definita dal Consiglio Nazionale degli Architetti e dal Consiglio Nazionale Ingegneri.



art. 16 - Proprietà delle proposte

L'Ente banditore avrà il diritto di fare proprie le proposte premiate, mentre il diritto d'autore relativo ad ogni progetto presentato resterà sempre del concorrente.

L'Ente Banditore e l'Ente Organizzatore una volta pubblicati gli elaborati sulla rete (nel sito dedicato al concorso ed alla mostra) non rispondono dell'uso che chiunque potrà fare degli elaborati e degli scritti.



art. 17 - Utilizzo dei progetti inviati

Gli elaborati resteranno nel sito dedicato al concorso per un anno dopo la conclusione del concorso stesso - questo per favorire la prosecuzione del dibattito intorno all'iniziativa e per conservare testimonianza dell'attività progettuale;

Trascorso tale periodo l'Ente banditore ha facoltà di cessare la pubblicazione in rete degli elaborati.

L'Ente banditore ha facoltà di utilizzare gli elaborati inviati - anche dopo la conclusione del concorso - allo scopo di promuovere l'iniziativa, l'architettura e l'arte nell'ambito di "Scandicci città sperimentale".

art. 3 - Documentazione riguardante il luogo e l'elaborazione del progetto

art. 4 - Condizioni di partecipazione

La partecipazione al concorso è aperta gli studenti europei e di tutto il mondo di ogni ordine e grado, fatte salve le incompatibilità di cui all'art. 5 del bando. Lo status di studente va dichiarato al momento dell'invio degli elaborati ed è da certificare - pena l'esclusione- nel caso che l'idea presentata risultasse fra quelle premiate o segnalate.

La partecipazione può essere individuale o di gruppo; nel secondo caso tutti i componenti del gruppo devono essere studenti.

Ad ogni effetto del presente concorso un gruppo di concorrenti avrà, collettivamente, gli stessi diritti di un singolo concorrente.

Ogni gruppo dovrà nominare un suo componente, quale delegato paritetico a rappresentarlo come capogruppo presso l'ente banditore, che dovrà essere indicato al momento dell'iscrizione, come meglio specificato al successivo art. 8

A tutti i componenti del gruppo è riconosciuta, a parità di titoli e diritti, la paternità delle proposte o del progetto concorrente.



art. 5 - Incompatibilità dei partecipanti

Non possono partecipare al concorso: o i componenti la giuria, i loro coniugi, i loro parenti ed affini fino al terzo grado compreso; o gli amministratori ed i consiglieri dell'Ente banditore. o i datori di lavoro o coloro che abbiano qualsiasi rapporto di lavoro o di collaborazione continuativo e notorio con membri della giuria; o coloro che hanno partecipato alla stesura del bando



art. 6 - Incompatibilità dei giurati

Non possono far parte della giuria: o i concorrenti, i loro coniugi, i loro parenti ed affini fino al terzo grado compreso o i datori di lavoro e i dipendenti dei concorrenti o coloro che con essi abbiano qualsiasi rapporto di lavoro o di collaborazione continuativo e notorio.

Non possono inoltre far parte contemporaneamente della giuria: o parenti ed affini fino al terzo grado compreso; o datori di lavoro e loro dipendenti; o coloro tra i quali intercorre qualsiasi rapporto di lavoro o di collaborazione continuativo e notorio.



art. 7 - Elaborati da presentare al concorso

Il numero e le dimensioni degli elaborati di progetto sono fissi e immodificabili; non sono ammessi elaborati in più o in meno o diversi di quelli appresso indicati.

Le lingue ufficiali con cui dovranno essere illustrati gli elaborati progettuali sono l'italiano e l'inglese.

Gli elaborati dovranno essere inviati via email e in forma palese.

Le proposte progettuali e le schede verranno contrassegnate in fase di accettazione dall'Ente banditore, con un numero progressivo relativo al numero di protocollo corrispondente all'ordine di arrivo; pertanto non dovrà essere riportato nessun tipo di motto o di codice alfanumerico sugli elaborati o sulla scheda presentati. Il numero assegnato verrà comunicato ai partecipanti attraverso una email che testimonierà l'avvenuta accettazione della proposta.

Le idee e le proposte progettuali dovranno essere rappresentate dai concorrenti sulle basi fornite dell'Ente Banditore e restituite in forma elettronica nei seguenti elaborati:
· n. 1 immagine della dimensione di 800x600 pixel in formato GIF / JPG contenente le indicazioni urbanistiche in una planimetria in scala 1:2000.
· n. 1 immagine della dimensione di 800x600 pixel in formato GIF / JPG contenente una pianta della piazza in scala 1:200.
· n. 1 immagine della dimensione di 800x600 pixel in formato GIF / JPG contenente sezioni della piazza in scala 1:200.
· n. 1 immagine della dimensione di 800x600 pixel in formato GIF / JPG contenente una rappresentazione libera della soluzione proposta.
· n. 1 documento di testo (in formato DOC o RTF) consistente in un massimo di 15.000 battute (circa 10 cartelle di testo) di descrizione dei criteri progettuali adottati, delle soluzioni proposte, della giustificazione della realizzabilità del progetto e delle scelte tecnico-costruttive.

art. 8 - Modalità di iscrizione

L'iscrizione al concorso coincide con la consegna degli elaborati. L'iscrizione e la consegna degli elaborati dovrà essere effettuata entro il sessantesimo giorno dalla pubblicazione del bando sulla Gazzetta ufficiale della Comunità europea e dovrà pervenire via email all'indirizzo concorso-b@bitcity.it.

Non è ammessa la consegna a mano e non saranno ammesse domande e consegna degli elaborati pervenute oltre tale termine.

Alla domanda dovrà essere allegata la scheda da compilare contenente un'autocertificazione in carta semplice (ai sensi degli artt. 2 e 3 della legge 15/1968) sottoscritta dal singolo partecipante o congiuntamente dai componenti del gruppo e contenente: o nome, cognome, data di nascita e cittadinanza; o domicilio e recapito telefonico di riferimento; o eventuale recapito fax e indirizzo di posta elettronica; o il delegato designato come capogruppo in caso di raggruppamento; o l'esplicita dichiarazione che il concorrente, singolo o in gruppo, non si avvarrà del diritto di anonimato durante l'esposizione dei progetti. 4 Testo del bando e informazioni sull'iscrizione saranno visibili sul sito http://scandicci.bitcity.it



art. 9 - Calendario e procedure

L'Ente banditore fino al termine del periodo previsto per l'iscrizione metterà a disposizione sul sito http://scandicci.bitcity.it il materiale documentario, del concorso.

I concorrenti, nei quaranta giorni successivi alla pubblicazione del bando sulla Gazzetta ufficiale della Comunità europea, potranno presentare quesiti all'indirizzo email info@bitcity.it.

Le risposte saranno fornite dall'Ente banditore in forma palese sullo stesso sito a tutti i concorrenti nei sette giorni seguenti, con le stesse modalità di ricevimento.

4
Alla scadenza del sessantesimo giorno successivo alla data di pubblicazione sulla Gazzetta ufficiale della Comunità europea, entro le ore 24 (ora italiana), gli elaborati dovranno pervenire all'indirizzo email concorso-b@bitcity.it.

Saranno esclusi tutti gli elaborati pervenuti oltre il suddetto termine.

art. 10 - Composizione e funzionamento degli organi giudicanti

Per tutte e tre le sezioni del bando è nominata dall'Ente banditore una Commissione tecnica, con il compito istruttorio di verificare, dopo la scadenza del termine per la consegna degli elaborati, che il materiale risulti pervenuto nei tempi e nei modi fissati nel bando e che gli elaborati siano conformi a quelli richiesti e con compiti di segreteria per il funzionamento della giuria.

A seguito dell'esame istruttorio svolto la Commissione tecnica fornirà l'elenco dei concorrenti non meritevoli di ammissione, con le motivazioni della loro possibile esclusione e compilerà inoltre in base All'ordine di arrivo la lista dei partecipanti secondo la quale gli elaborati inviati dovranno essere esaminati dalla giuria.

Per tutte e tre le sezioni del bando è nominata una Giuria esaminatrice comprendente un numero dispari di membri, con lo scopo di esaminare e valutare gli elaborati selezionati e di individuare il vincitore, che sarà unico, non essendo prevista una situazione di parità.

La Giuria dovrà contare, nella sua composizione, su una maggioranza di tecnici quali membri effettivi, con altrettanti membri supplenti, scelti tra progettisti esperti del settore, o che abbiano già svolto compiti di giurato in concorsi di pari importanza o vi abbiano partecipato conseguendo un premio.

La Giuria sarà composta dai seguenti sette giurati effettivi con diritto di voto e da altrettanti supplenti: o n. 5 esperti effettivi e n. 5 supplenti nominati dall'Ente banditore
· n. 1 rappresentante effettivo e n. 1 supplente nominato dal Consiglio Nazionale degli Architetti
· n. 1 rappresentante effettivo e n. 1 supplente nominato dal Consiglio Nazionale degli Ingegneri

Le riunioni della Giuria relativamente alla nomina dei vincitori saranno valide solo con la presenza dei 7 giurati.

Quando un membro effettivo è assente, per sopravvenuta impossibilità o qualsiasi altro motivo di cui deve dare comunicazione all'Ente banditore almeno tre giorni prima della seduta, decade ed è sostituito dal corrispondente giurato supplente o, in caso di sua indisponibilità, da un altro dei supplenti.

Fungerà da segretario senza diritto di voto un componente della commissione tecnica che potrà essere coadiuvato da incaricati di segreteria, con il compito di redigere il verbale delle sedute e di comunicare risultati, criteri, valutazioni e motivazioni delle scelte agli Ordini territorialmente competenti.

Il presidente della Giuria sarà eletto da tutti i suoi componenti alla prima riunione, tra i membri effettivi nominati dall'Ente banditore.

I componenti la Giuria non potranno ricevere, dall'Ente banditore o da chi subentrasse nelle sue funzioni successivamente all'espletamento del concorso, incarichi di progettazione o di consulenza per la progettazione inerenti l'oggetto del concorso, sia singolarmente sia come componenti di un gruppo.

A ciascuno dei membri della Giuria, per la partecipazione alle tre sezioni, sarà corrisposto un gettone onnicomprensivo di presenza e di rimborso spese di £. 900.000 Euro 465 (di £. 1.800.000 Euro 930 a quelli con residenza abituale ubicata ad una distanza di oltre 400 Km dalla sede del concorso) al lordo della ritenuta d'acconto ed al netto di IVA ed oneri previdenziali.

I membri della Commissione tecnica e della Giuria, con i relativi membri supplenti, saranno nominati e resi pubblici sino dalla pubblicazione del bando, al fine della valutazione di eventuali incompatibilità.



art. 11 - Lavori della Giuria

1
La Giuria, convocata con almeno 15 giorni di preavviso, dovrà iniziare i propri lavori comunque entro 10 giorni dalla data di scadenza per la consegna degli elaborati da parte dei concorrenti.

Nel caso in cui non si potesse riunire o non concludesse i lavori nei termini stabiliti, verrà distribuito in misura uguale tra tutti i partecipanti, la cui iscrizione sia stata giudicata regolare dalla Commissione tecnica, il 50% dei montepremi complessivo.

Ogni giurato disporrà di un voto, le decisioni verranno prese a maggioranza e saranno inappellabili.

La Giuria redige la relazione contenente la valutazione delle idee premiate e segnalate con le relative motivazioni, la descrizione della metodologia seguita dai commissari per la loro valutazione e l'iter del lavoro svolto, e sarà pubblica con la nomina dei vincitori.

Formata la graduatoria finale la Giuria definirà l'assegnazione dei premi, fermo restando che il primo premio potrebbe non essere assegnato qualora all'unanimità i membri non ritenessero alcun progetto meritevole di tale conferimento.

Graduatoria definitiva, elenco di tutti i partecipanti e relazione conclusiva della Giuria saranno resi pubblici sul sito ed inviati ai Consigli Nazionali degli Architetti e degli Ingegneri ed agli Ordini professionali territorialmente competenti.



art. 12 - Esito del concorso e premi

Il concorso si concluderà con una graduatoria di merito ed i premi (al lordo della ritenuta d'acconto ed al netto di IVA ed oneri previdenziali) saranno assegnati come segue: - un importo di £. 3.000.000 (tre milioni di lire) Euro 1549al primo classificato; - un importo di £. 1.500.000 (un milione cinquecentomila lire) Euro 775 al secondo classificato - un importo di £. 1.000.000 (un milione di lire) Euro 517 al terzo classificato La giuria avrà a disposizione inoltre la possibilità di n. 10 segnalazioni.



art. 13 - Esecuzione dell'opera

L'Ente banditore, o una stazione appaltante che gli subentri, si riservano la facoltà di utilizzare l'idea per realizzare l'opera oggetto del concorso.



art. 14 - Pubblicizzazione dei progetti

I progetti - organizzati con la classificazione proposta dalla giuria - provvederà, con modi e tempi da stabilire, ma comunque entro 30 giorni dalla proclamazione dei vincitori del concorso, ad organizzare sul sito del concorso una mostra di tutti gli elaborati presentati, e uno spazio per un forum pubblico online al quale sono invitati a prendere parte gli estensori dei progetti premiati e non, per continuare ad illustrare pubblicamente le loro idee e proposte progettuali.

I partecipanti possono richiedere - al momento dell'iscrizione/invio degli elaborati - di non pubblicare sulla rete i propri elaborati. Tale richiesta non potrà essere accolta dall'Ente banditore (pena la rinuncia da parte dei concorrenti con relativa esclusione) nell'eventualità i progetti risultassero premiati o segnalati.

L'ente banditore si riserva l'opportunità di pubblicare i risultati del concorso in forma cartacea o altre procedure.



art. 15 - Regolarità del bando e dispute

Il presente bando è stato redatto in conformità alle indicazioni fornite dal Consiglio Nazionale degli Architetti e dal Consiglio Nazionali degli Ingegneri, ai quali è stato preliminarmente sottoposto ai fini dell'approvazione.

E' stato inoltre pubblicizzato per favorire la conoscenza, la diffusione e la partecipazione al concorso.

Ogni eventuale disputa riguardante le procedure della competizione per la sezione studenti sarà affidata ad un collegio arbitrale formato da un esperto nominato dall'Ente Banditore, un esperto nominato dalla parte e un esperto nominato dal tribunale competente.



art. 16 - Proprietà delle proposte

L'Ente banditore avrà il diritto di fare proprie le proposte premiate, mentre il diritto d'autore relativo ad ogni progetto presentato resterà sempre del concorrente. 2 L'Ente Banditore e l'Ente Organizzatore una volta pubblicati gli elaborati sulla rete (nel sito dedicato al concorso ed alla mostra) non rispondono dell'uso che chiunque potrà fare degli elaborati e degli scritti.



art. 17 - Utilizzo dei progetti inviati

Gli elaborati resteranno nel sito dedicato al concorso per un anno dopo la conclusione del concorso stesso - questo per favorire la prosecuzione del dibattito intorno all'iniziativa e per conservare testimonianza dell'attività progettuale;

Trascorso tale periodo l'Ente banditore ha facoltà di cessare la pubblicazione in rete degli elaborati.

L'Ente banditore ha facoltà di utilizzare gli elaborati inviati - anche dopo la conclusione del concorso - allo scopo di promuovere l'iniziativa, l'architettura e l'arte nell'ambito di "Scandicci città sperimentale" . artisti



art. 3 - Documentazione riguardante il luogo e l'elaborazione del progetto

Costituiscono parte integrante del bando di concorso i seguenti materiali che saranno disponibili sulla rete e che faranno da linee guida per tutti i partecipanti. allegato 1, Linee-guida contenenti la descrizione delle caratteristiche, delle funzioni e del sistema dei requisiti dell'area; allegato 2, Materiali di base per l'esecuzione degli elaborati di concorso, riportante l'orientamento e la perimetrazione dell'area al cui interno si devono realizzare gli interventi.

Resta inteso che l'area oggetto del concorso comprende esclusivamente il sedime pubblico pavimentabile, con esclusione degli edifici che su di esso insistono o che lo racchiudono, avente come ambito l'area di piazza Matteotti.

Altre informazioni sono contenute nei materiali di cui al punto 1. Gli elaborati grafici sono tutti in formato digitale di dimensione 800x600 pixel e saranno restituiti da tutti i partecipanti completati con l'idea proposta.

E' vietato - pena l'esclusione- presentare elaborati aggiuntivi o di formato differente da quello richiesto.



art. 4 - Condizioni di partecipazione

La partecipazione al concorso è aperta agli artisti ed operatori della cultura di tutto il mondo, fatte salve le incompatibilità di cui all'art. 5 del bando. Lo status di artista va dichiarato al momento dell'invio degli elaborati ed è da dimostrare alla giuria con l'invio curriculum vitae - pena l'esclusione - nel caso che l'idea presentata risultasse fra quelle premiate o segnalate.

La partecipazione può essere individuale o di gruppo; nel secondo caso tutti i componenti del gruppo devono essere nelle condizioni del comma precedente.

Ad ogni effetto del presente concorso un gruppo di concorrenti avrà, collettivamente, gli stessi diritti di un singolo concorrente.

Ogni gruppo dovrà nominare un suo componente, quale delegato paritetico a rappresentarlo come capogruppo presso l'ente banditore, che dovrà essere indicato al momento dell'iscrizione, come meglio specificato al successivo art. 8

A tutti i componenti del gruppo è riconosciuta, a parità di titoli e diritti, la paternità delle proposte o del progetto concorrente.

Al concorrente singolo o ai concorrenti in gruppo È consentito di avvalersi di consulenti o di collaboratori, che non dovranno trovarsi nelle condizioni di incompatibilità di cui al successivo art. 5 e non potranno essere componenti del gruppo.

I loro compiti ed attribuzioni saranno definiti all'interno del gruppo concorrente senza investire del loro rapporto l'Ente banditore, al quale dovrà essere comunque dichiarata la qualifica e la natura della loro consulenza o collaborazione.



art. 5 - Incompatibilità dei partecipanti

Non possono partecipare al concorso: o i componenti la giuria, i loro coniugi, i loro parenti ed affini fino al terzo grado compreso; o gli amministratori, i consiglieri ed i dipendenti dell'Ente banditore, anche con contratto a termine, i consulenti dello stesso Ente con contratto continuativo o i datori di lavoro o coloro che abbiano qualsiasi rapporto di lavoro o di collaborazione continuativo e notorio con membri della giuria; o coloro che hanno partecipato alla stesura del bando o coloro che hanno rapporti di lavoro dipendente a tempo pieno con enti, istituzioni o amministrazioni pubbliche, ma tale norma opera soltanto nei confronti dei concorrenti che si presentano singolarmente o dei delegati dai gruppi a rappresentarli come capogruppo



art. 6 - Incompatibilità dei giurati

Per tutte e tre le sezioni del bando è nominata una Giuria esaminatrice comprendente un numero dispari di membri, con lo scopo di esaminare e valutare gli elaborati selezionati e di individuare il vincitore, che sarà unico, non essendo prevista una situazione di parità.

La Giuria dovrà contare, nella sua composizione, su una maggioranza di tecnici quali membri effettivi, con altrettanti membri supplenti, scelti tra progettisti esperti del settore, o che abbiano già svolto compiti di giurato in concorsi di pari importanza o vi abbiano partecipato conseguendo un premio.

La Giuria sarà composta dai seguenti sette giurati effettivi con diritto di voto e da altrettanti supplenti: o n. 5 esperti effettivi e n. 5 supplenti nominati dall'Ente banditore o n. 1 rappresentante effettivo e n. 1 supplente nominato dal Consiglio Nazionale degli Architetti o n. 1 rappresentante effettivo e n. 1 supplente nominato dal Consiglio Nazionale degli Ingegneri 6 Le riunioni della Giuria relativamente alla nomina dei vincitori saranno valide solo con la presenza dei 7 giurati. 7 Quando un membro effettivo è assente, per sopravvenuta impossibilità o qualsiasi altro motivo di cui deve dare comunicazione all'Ente banditore almeno tre giorni prima della seduta, decade ed è sostituito dal corrispondente giurato supplente o, in caso di sua indisponibilità, da un altro dei supplenti.

Fungerà da segretario senza diritto di voto un componente della commissione tecnica che potrà essere coadiuvato da incaricati di segreteria, con il compito di redigere il verbale delle sedute e di comunicare risultati, criteri, valutazioni e motivazioni delle scelte agli Ordini territorialmente competenti.

Il presidente della Giuria sarà eletto da tutti i suoi componenti alla prima riunione, tra i membri effettivi nominati dall'Ente banditore.

I componenti la Giuria non potranno ricevere, dall'Ente banditore o da chi subentrasse nelle sue funzioni successivamente all'espletamento del concorso, incarichi di progettazione o di consulenza per la progettazione inerenti l'oggetto del concorso, sia singolarmente sia come componenti di un gruppo.

A ciascuno dei membri della Giuria sarà corrisposto, per la partecipazione alle tre sezioni, un gettone onnicomprensivo di presenza e di rimborso spese di £. 900.000 Euro 465 (di £. 1.800.000 Euro 930 a quelli con residenza abituale ubicata ad una distanza di oltre 400 Km dalla sede del concorso) al lordo della ritenuta d'acconto ed al netto di IVA ed oneri previdenziali. 12 I membri della Commissione tecnica e della Giuria, con i relativi membri supplenti, saranno nominati e resi pubblici sino dalla pubblicazione del bando, al fine della valutazione di eventuali incompatibilità.



art. 11 - Lavori della Giuria

La Giuria, convocata con almeno 15 giorni di preavviso, dovrà iniziare i propri lavori comunque entro 10 giorni dalla data di scadenza per la consegna degli elaborati da parte dei concorrenti.

Nel caso in cui non si potesse riunire o non concludesse i lavori nei termini stabiliti, verrà distribuito in misura uguale tra tutti i partecipanti, la cui iscrizione sia stata giudicata regolare dalla Commissione tecnica, il 50% dei montepremi complessivo.

Ogni giurato disporrà di un voto, le decisioni verranno prese a maggioranza e saranno inappellabili.

La Giuria redige la relazione, contenente la valutazione delle idee premiate e segnalate con le relative motivazioni, la descrizione della metodologia seguita dai commissari per la loro valutazione e l'iter del lavoro svolto, e sarà resa pubblica con la nomina dei vincitori.

Formata la graduatoria finale la Giuria definirà l'assegnazione dei premi, fermo restando che il primo premio potrebbe non essere assegnato qualora all'unanimità i membri non ritenessero alcun progetto meritevole di tale conferimento.

Graduatoria definitiva, elenco di tutti i partecipanti e relazione conclusiva della Giuria saranno resi pubblici sul sito ed inviati ai Consigli Nazionali degli Architetti e degli Ingegneri ed agli Ordini professionali territorialmente competenti.



art. 12 - Esito del concorso e premi

Il concorso si concluderà con una graduatoria di merito ed i premi (al lordo della ritenuta d'acconto ed al netto di IVA ed oneri previdenziali) saranno assegnati come segue: - un importo di £. 4.000.000 (quattro milioni di lire) Euro 2066 al primo classificato; - un importo di £. 2.000.000 (due milioni di lire) Euro 1033 al secondo classificato - un importo di £. 1.500.000 (un milione cinquecentomila di lire) Euro 775 al terzo classificato La giuria avrà a disposizione inoltre la possibilità di n. 10 segnalazioni.



art. 13 - Esecuzione dell'opera

L'Ente banditore, o una stazione appaltante che gli subentri, si riservano la facoltà di realizzare l'opera oggetto del concorso.

Nel caso che l'opera venga realizzata, l'incarico per la consulenza alla redazione del progetto definitivo ed esecutivo ( o la consulenza nel caso si utilizzino strutture tecnche interne alla Amministrazione ) verrà comunque affidato all'estensore del progetto vincitore, che dovrà redigerlo secondo le indicazioni e le richieste dell'Ente banditore, il quale potrà richiedere l'introduzione di modifiche e perfezionamenti, senza che ciò comporti ulteriore compenso oltre a quanto stabilito per la stesura di tale progetto.

Per l'incarico per la consulenza alla redazione del progetto sarà stipulata apposita convenzione con gli artisti, fermo restando che, nel caso che il progetto vincitore sia stato redatto da un gruppo, l'Ente banditore la stipulerà con il solo delegato come capogruppo del gruppo stesso, riconoscendogli i compensi spettanti ad un singolo professionista e mantenendosi estraneo agli accordi stabiliti tra loro e con lui dagli altri componenti.

I compensi saranno determinati in conformità alle tariffe ed ai regolamenti in materia vigenti al momento del conferimento dell'incarico; su di essi verrà praticata la riduzione dell'importo, nella misura del 20%, consentita dalla legge 155/1989.



art. 14 - Pubblicizzazione dei progetti

I progetti - organizzati con la classificazione proposta dalla giuria - provvederà, con modi e tempi da stabilire, ma comunque entro 30 giorni dalla proclamazione dei vincitori del concorso, ad organizzare sul sito del concorso una mostra di tutti gli elaborati presentati, e uno spazio per un forum pubblico online al quale sono invitati a prendere parte gli estensori dei progetti premiati e non, per continuare ad illustrare pubblicamente le loro idee e proposte progettuali.

I partecipanti possono richiedere - al momento dell'iscrizione/invio degli elaborati - di non pubblicare sulla rete i propri elaborati. Tale richiesta non potrà essere accolta dall'Ente banditore (pena la rinuncia da parte dei concorrenti con relativa esclusione) nell'eventualità i progetti risultassero premiati o segnalati. 3 L'ente banditore si riserva l'opportunità di pubblicare i risultati del concorso in forma cartacea o altro¼



art. 15 - Regolarità del bando e dispute

Il presente bando è stato redatto in conformità alle indicazioni fornite dal Consiglio Nazionale degli Architetti e dal Consiglio Nazionali degli Ingegneri, ai quali è stato preliminarmente sottoposto ai fini dell'approvazione.

E' stato inoltre pubblicizzato per favorire la conoscenza, la diffusione e la partecipazione al concorso.

Ogni eventuale disputa per la sezione Artisti riguardante le procedure della competizione sarà affidata ad un collegio arbitrale formato da un esperto nominato dall'Ente Banditore, un esperto nominato dalla parte e un esperto nominato dal tribunale competente.



art. 16 - Proprietà delle proposte

L'Ente banditore avrà il diritto di fare proprie le proposte premiate, mentre il diritto d'autore relativo ad ogni progetto presentato resterà sempre del concorrente.

L'Ente Banditore e l'Ente Organizzatore una volta pubblicati gli elaborati sulla rete (nel sito dedicato al concorso ed alla mostra) non rispondono dell'uso che chiunque potrà fare degli elaborati e degli scritti.



art. 17 - Utilizzo dei progetti inviati

Gli elaborati resteranno nel sito dedicato al concorso per un anno dopo la conclusione del concorso stesso - questo per favorire la prosecuzione del dibattito intorno all'iniziativa e per conservare testimonianza dell'attività progettuale;

Trascorso tale periodo l'Ente banditore ha facoltà di cessare la pubblicazione in rete degli elaborati. 3 L'Ente banditore ha facoltà di utilizzare gli elaborati inviati - anche dopo la conclusione del concorso - allo scopo di promuovere l'iniziativa, l'architettura e l'arte nell'ambito di "Scandicci città sperimentale" .

Premise

The on-line competition for the new layout of Piazza Matteotti is part of the SCANDICCI CITTÀ SPERIMENTALE (Scandicci Experimental City) project. This project was set up to offer the city of Scandicci a website configured to act as an interactive tool between the Municipal Administration, project designers, creative artists and citizens. The purpose was to provide the city with a dynamic system for displaying the project processes involved in developing the new city over the years to come. Some of the main objectives of the project were: the promotion - on an international scale - of the artistic, economic and production resources of the territory, of the architecture and of the services available; the improved utilisation - through the use of the internet - of the specific identities of the Municipality of Scandicci, promoting the possibilities for communication and project/creative activity that the particular geographical and cultural collocation of the territory provides, responding contemporaneously to the dynamics of the society and the city. With the competition for the new layout of Piazza Matteotti, Scandicci is inaugurating and experimenting with original competition procedures. These procedures make maximum use of the internet: from the initial stage of launching the notice of competition to the management of the proposals, from the activities of the adjudicating commission to the publication of the results. Besides simplifying the traditional procedures, the on-line competition integrates and extends the possibilities for involvement and diffusion. In this sense, and as a first phase of the SCANDICCI CITTÀ SPERIMENTALE project, the structure set up for the competition is providing an important initial opportunity to reflect on city-planning in the transformation of urban space within the Municipality of Scandicci.



art. 1 - Structure of the competition

The Municipal Administration of Scandicci hereby gives notice of a competition for ideas, at an international European level and in public format.
The competition is structured in three sections:
A) The first section - open to all project designers in possession of the requisites detailed in art. 4 below;
B) The second section - open to students of all kinds and degree from Europe and the rest of the world;
C) The third section - open to artists and operators from cultures of the whole world.

The competition will take place in a single phase and will conclude with the award-giving to the winners and the distinguished entries.



art. 2 - Objective and themes of the competition

The competition is being held in order to provide the City of Scandicci with the best concept for the layout and environmental transformation of the area of piazza Matteotti. The following aspects must be taken into account:
· while the complete freedom of project ideas and expression remains valid, it should be noted the project area is enclosed inside the surrounding street system, composed of roadways, parking lots, pavements;
· the surrounding street system may be subject to re-arrangement;
· the existing monument at the centre of the piazza may be relocated or removed, or replaced with another symbolic element;
· the lighting system components and fittings must have low impact in terms of light pollution;
· the existing trees and plants are to be preserved; proposals may be made for their restoration and integration;
· the estimated cost of the works is one billion lire (euro 516,457).



SECTION A

art. 3 - Documentation on the site and the development of the entries

The material below is an integral part of the notice of competitive examination; it will be made available on the internet and will serve as a guideline for all the participants:
Attachment 1 - Guidelines containing a description of the characteristics, functions and system requirements of the area; Attachment 2 - Basic material required for executing the entries for the competition, providing the orientation and the perimeters of the area within which the interventions will have to be carried out.

It is understood that the area that is the subject of the competition is the area of Piazza Matteotti, consisting exclusively of the public part that may be paved, with the exclusion of the buildings that face onto the area or which enclose it.

The documents mentioned in point 1 contain further information. The graphic papers are all in digital format, with dimensions of 800x600 pixels, and will be returned by all the participants completed with the proposed project.

It is prohibited to present additional papers or to make presentations in formats other than the format requested. Non-compliance will result in exclusion from the competition.



art. 4 - Conditions of participation

1
Participation in the competition is open to architects and engineers enrolled in the registers of their respective professional associations in their countries, as well as project designers who are legally qualified and enrolled in their respective categories or associations within the European Union; such parties are not prohibited - upon entering the competition - from operating in a self-employed manner, whether by law, by contract or by professional arrangement, the incompatibility standards described in article 5 of this notice remaining valid.

Participation may be individual or group; in the latter case, all the members of the group must be in possession of the requirements as detailed in the preceding paragraph of this article.

To all effects of the present competition, a group of competitors will have, collectively, the same rights as an individual competitor.

Each group must appoint one member as joint delegate to represent it as group leader with the Competition Notifying Body; this member must be indicated upon enrolling in the competition, as specified more fully in art. 8 below.

The ownership of the competing project or proposals is acknowledged as appertaining to all the members of the group.

Individual competitors and group competitors may avail of consultants and collaborators, who may or may not be in enrolled in the Registers referred to in the first paragraph of this article; such individuals must not however be in a position of incompatibility as described in art. 5 below and must not be members of the group.

The roles and attributions of any consultants/collaborators will be defined within the competing group; the Competition Notifying Body need not be informed of their relationship to the group, but it must be informed of the qualification and nature of their consultation or collaboration.



art. 5 - Incompatibility of participants

The following parties may not participate in the competition:
· the members of the jury, their spouses, their relatives up to and including the third degree of kin
· the administrators and counsellors of the Competition Notifying Body;
· the employers of the jury or those who have any ongoing and acknowledged working or collaborative relationship with members of the jury;
· those who participated in the drawing up of the competition notice;
· those who are full-time employees of the Competition Notifying Body or who are employees of public institutional or administrative bodies, who for institutional purposes have duties of handling or checking the competition material.



art. 6 - Incompatibility of the jurors

The following cannot be members of the jury:
the competitors, their spouses, their relatives up to and including the third degree of kin; o the employers and employees of the competitors or those who have any type of ongoing and acknowledged working or collaborative relationship with the competitors.

In addition, the following cannot be members of the jury together:
· individuals who are related to each other, up to and including the third degree of kin;
· employers and their employees;
· individuals who have any acknowledged and ongoing working or collaborative relationship with each other.



art. 7 - Papers to be presented to the competition

1
The number and dimensions of the project papers are fixed and unchangeable; greater or lesser numbers of papers are not acceptable, nor are papers that are different from those indicated below.

The official languages in which the project papers must be illustrated are Italian and English.

The papers must be sent by email and in open form.

The project proposals and the charts will be marked upon acceptance by the Competition Notifying Body with a serial number that relates to the protocol number corresponding to the order of arrival. Therefore, there must not be any kind of motto or alphanumeric code on the papers or chart presented. The number assigned will be communicated to the participants by email; this communication will attest that the proposal has been accepted.

The project ideas and proposals must be represented by the competitors on the bases provided by the Competition Organising Body and sent in, in digital format, in the following forms:
· 1 image in the dimensions of 800x600 pixels, in GIF/JPG format, containing the town-planning indications in a blueprint with a scale of 1:2000.
· 1 image in the dimensions of 800x600 pixels, in GIF/JPG format, containing a map of the piazza with a scale of 1:200
· 1 image in the dimensions of 800x600 pixels, in GIF/JPG format, containing sections of the piazza with a scale of 1:200.
· 1 image in the dimensions of 800x600 pixels, in GIF/JPG format, containing a free representation of the proposed layout.
· 1 text document (in format DOC or RTF) consisting of a maximum of 15,000 characters (approximately 10 typewritten pages) with a description of the project criteria adopted, the proposed solutions, as well as a description of the construction feasibility of the project and the technical-construction choices.

art. 8 - Inscription procedures

Inscription into the competition occurs upon delivery of the papers and the payment - for the participants in section A - of an inscription fee of Lit. 100,000 (equal to 51.64 euro), in accordance with the indicated modalities.

Inscription to the competition and delivery of the papers must take place within the sixtieth day from the publication of the competition notice in the official Gazette of the European Community and must arrive by email to this email address: concorso-a@scandicci.bitcity.it

Delivery by hand is not acceptable, nor will entries be accepted in the event that papers arrive after the above term has expired.

A completed entry form will have to be attached to the application, containing:
· the first name, surname, date of birth and citizenship of the applicant;
· the home address and telephone number of reference;
· fax number (if possible) and email address;
· the details of the applicant's inscription in the respective professional association (collaborators and consultants are excluded from this requirement);
· in the event of a group application, the name of the delegated group leader;
· academic and professional qualifications;
· a statement that the applicant is not bound by prohibitions on professional work as described in art. 4 or limited by the incompatibility specifications in art. 5;
· declaration on the part of consultants and/or collaborators (if any) regarding the qualification and nature of the performances carried out;
· professional competitors coming from the countries of the European Union must present a self-written declaration, composed in according with EEC Directive 85/384, ratified with legislative decree n. 129 of 27 January 1992.
· for full-time employees of public bodies, institutes or administrations, a declaration of possession of the authorisation, produced and signed by the their employer, to participate in the competition. The declaration must be dated prior to the delivery of the papers and must be produced in the event that the concept presented is found to be among the winning or distinguished entries. Failure to produce the declaration will result in disqualification.
· an explicit declaration that the competitor, whether individual or group, will not avail of the right to anonymity during the exhibition of the projects.

art. 9 - Calendar and procedures

Up until the end of the time period allowed for inscription, the Competition Notifying Body will make the documentation on the competition available on its website (http://scandicci.bitcity.it).

For forty days after the publication of the competition notice in the official Gazette of the European community, the competitors may make enquiries to the email address info@scandicci.bitcity.it

The replies to these inquiries will be supplied by the Competition Notifying Body in an open format on its website to all the competitors over the course of the following seven days, with the same reception modalities.

When the sixtieth day from the date of publication in the official Gazette of the European Union has passed, within 24 hours (Italian time) the papers should arrive at the email address concorso-a@scandicci.bitcity.it

Any papers arriving after the above term has expired will be excluded.

The definitive results of the competition will be published on the website http://scandicci.bitcity.it and will be communicated to the National Council of Architects, the National Council of Engineers and to the other professional associations territorially involved.

art. 10 - Composition and functioning of the adjudicating bodies

For all three sections of the competition, the Competition Notifying Body appoints a Technical Commission, whose preliminary task will be to check, after the expiration date for delivery of the papers has passed, that the material has arrived on time and in the manner established by the competition notice and that the papers conform to the requirements; this commission will also have a secretarial role in the functioning of the jury.

After the preliminary inspection has been carried out, the Technical Commission will furnish a list of the applicants whose papers were not accepted, with an explanation for their possible exclusion. The Commission will also compile, on the basis of the order of arrival, a list of the participants, in keeping with which the papers received will have to be examined by the jury.

An examining Jury will be appointed for all three sections of the competition. This Jury will have an odd number of members, whose objective will be to examine and evaluate the papers selected and to choose a winner; there will be only one winner, since a 'draw' is not acceptable.

In its composition, the Jury will be made up of a majority of technicians as effective members, with an equal number of supplementary members, made up of expert project designers from the sector, or individuals who have already carried out the role of juror in competitions of equal importance or who have participated in such and have been awarded a prize.

The Jury will be composed of the following seven effective jurors, who will have the right to vote and by the same number of supplementary members: 5 effective experts and 5 supplementary members appointed by the Competition Notifying Body;
· 1 effective representative and 1 supplementary member appointed by the National Council of Architects;
· 1 effective representative and 1 supplementary member appointed by the National Council of Engineers

The meetings of the Jury to decide the winners of the competition will be valid only in the presence of the 7 jurors.

When an effective member is absent, because of circumstances beyond their control or for any other reason (of which the Competition Notifying Body must be informed at least three days prior to the meeting), the position will be forfeited and he or she will be replaced by the corresponding supplementary juror, or, in the event that the latter individual is unavailable, by one of the other supplementary jurors.

A member of the Technical Commission will act as secretary without the right to vote and may be assisted in secretarial duties; this individual will write up the minutes of the meetings and communicate the results, criteria, evaluations and motivations for the choices made to the professional associations for each territory involved.

The president of the Jury will be elected by all the members at the first sitting, from among the effective members appointed by the Competition Notifying Body.

The members of the Jury may not take on - either from the Competition Notifying Body or from whoever takes over its roles after the competition has been completed - roles of planning or consultation for the project that is the subject of the competition, neither individually nor as members of a group.

For their participation in the three sections, each member of the Jury will be paid a single sum to cover their presence and their expense reimbursements. This sum will be Lit. 900,000 or Euro 465 (Lit. 1,800,000 or Euro 930 to jury members whose permanent residence is located at a distance of over 400 km from the site of the competition), gross of withholding tax and net of VAT and social security dues.

The members of the Technical Commission and the Jury, and the respective supplementary members, will be appointed and publicly announced from the date of publication of the competition notice, so that evaluation may be carried out and possible incompatibility may be checked.



art. 11 - Role of the Jury

The Jury, which will be convoked with at least 15 days prior notice, must begin their work at least 10 days before the final date for delivery of papers on the part of competitors.

In the event that it is not possible to meet or in the event that the jury's work is not completed within the established time period, 50% of the total prize money will be distributed in equal parts to all the participants whose inscription has been adjudged correct by the Technical Commission.

Each juror will have one vote and decisions will be reached by a majority of votes; decisions will be incontestable.

The Jury will write a report containing an evaluation of the prize-winning and distinguished ideas; the report will provide reasons for the choice, a description of the methodology used by the commissioners in their evaluation and the sequence of the work carried out. The report will be made public along with the announcement of the winners.

When the final classification list has been drawn up, the Jury will assign the prizes. The first prize may not be assigned at all, in the event that the members of the Jury unanimously decide that there was no project that deserved to achieve that award.

The definitive classification list, the list of all the participants and the concluding report written by the Jury will be made public on the website and sent to the National Councils of Architects and Engineers and to the professional associations in the respective territories.



art. 12 - Result of the competition and prizes

The competition will conclude with a classification listing of merit and the prizes (gross of withholding tax and net of IVA and social security dues) will be assigned as follows:
· one amount of Lit. 5,000,000 (five million lire) or Euro 2,582 to the winning project;
· one amount of Lit. 3,000,000 (three million lire) or Euro 1,549 to the second-placed project;
· one amount of Lit. 1,500,000 (one million five hundred thousand lire) or Euro 775 to the third-placed project.
The jury will also have the possibility of assigning 10 distinguished entries.

The commitee, in case of further resources, coming from - earnings form subscriptions or sponsorization, reserve the right to: proportionally increase the amount of prizes and yeld the jury - a jackpot prize for submissions

The prize for the project adjudged to be best will be considered as an advance on the payments that will be made to its author in the event that the construction project is assigned to him/her or as an advance on payment for consultation for the definitive-executive project, as is better explained in article 13 below.



art. 13 - Execution of the work

The Competition Notifying Body, or a contracted agent that may take its place, reserves the right to carry out the construction project that is the subject of the competition.

In the event that the work is carried out, the task of drawing up the definitive and executive project (or consultation, in the event that structures are used which appertain to the Administration) will anyway be assigned to the author of the winning project. The latter will however have to draw up the project in accordance with the indications and requests of the Competition Notifying Body, who may request the introduction of changes and/or final touches, with the possibility of using the ideas presented by the winners of sections B and C of the present competition. Such measures will not oblige the organising Body to make further payments above the payments stipulated for the drawing up of such a project.

The Competition Notifying Body, or the body that may take its place, will have the right to entrust the co-ordination of the safety for the execution of the works (in accordance with law 494/1996), as well as the direction of the works that are the subject of the present competition, to parties other than the winner. Such parties will be chosen by means of the selection processes allowed under the current regulations for public works. In such a case, the Body will be under no obligation to make additional payment to the author of the definitive-executive project, apart from the payment that is due for artistic direction of the works or for consultation, both of which will remain his or her duty in any event.

The payment amounts will be determined in conformity with professional rates and with the regulations in force when the assignment is made; the 20% reduction allowed by law 155/1989 will be applied to such payment amounts.



art. 14 - Publication of the projects

In a manner and time period to be established, but in any event within 30 days from the proclamation of the competition winners, the projects - organised with the classification proposed by the jury - will be exhibited on the organisation's website. In this site will be displayed all the papers presented and a public forum will be set up to allow for on-line discussion to take place; the authors of the winning and non-winning projects will be invited to take place in this discussion, in order to continue to publicly illustrate their ideas and project proposals.

The participants may request - upon inscription and the sending in of their papers - that their work not be published on the internet. This request will not be accepted by the Competition Notifying Body in the event that the projects in question are among the winners or the distinguished entries. Failure to accept this on the part of the competitors may result in their entries be excluded from the competition.

The Competition Notifying Body reserves the right publish the results of the competition on paper or by other means.



art. 15 - Correctness of the competition notice and disputes

The present competition notice has been drawn up in conformity with the instructions provided by the National Council of Architects and the National Council of Engineers, to whom it was first shown for purposes of approval.

The present competition notice was also transmitted to the associations involved, with an invitation to publish it directly for the attention of their members.

Any dispute that may arise regarding the procedures of the competition will be entrusted to the evaluation of the authority chosen by the National Council of Architects and the National Council of Engineers.

The Competition Notifying Body will have the right to ownership of the winning proposals, while the copyright for each of the projects presented will remain the competitor's possession.

art. 17 - Use of the projects consigned

The papers will remain on the site dedicated to the competition for one year after the conclusion of the competition itself; this is in order to encourage the debate surrounding the initiative and in order to preserve a record of the project activity.

It is understood that the area that is the subject of the competition is the area of Piazza Matteotti, consisting exclusively of the public part that may be paved, with the exclusion of the buildings that face onto the area or which enclose it.

The documents mentioned in point 1 contain further information. The graphic papers are all in digital format, with dimensions of 800x600 pixels, and will be returned by all the participants completed with the proposed project.

art. 4 - Conditions of participation

Participation in the competition is open to European and world-wide student of any order or degree, the incompatibility standards described in article 5 of this notice remaining valid. The status of student must be declared upon sending in the paper and must be proven by certificate in the event that the concept presented is among the winners or distinguished entries. Failure to prove the status of student will result in disqualification.

Participation may be individual or group; in the latter case, all the members of the group must be students.

To all effects of the present competition, a group of competitors will have, collectively, the same rights as an individual competitor.

Each group must appoint one member as joint delegate to represent it as group leader with the Competition Notifying Body; this member must be indicated upon enrolling in the competition, as specified more fully in art. 8 below.

The ownership of the competing project or proposals is acknowledged as appertaining to all the members of the group.

The project ideas and proposals must be represented by the competitors on the bases provided by the Competition Organising Body and sent in, in digital format, in the following forms:
· 1 image in the dimensions of 800x600 pixels, in GIF/JPG format, containing the town-planning indications with a scale of 1:2000.
· 1 image in the dimensions of 800x600 pixels, in GIF/JPG format, containing a map of the piazza with a scale of 1:200.
· 1 image in the dimensions of 800x600 pixels, in GIF/JPG format, containing sections of the piazza with a scale of 1:200.
· 1 image in the dimensions of 800x600 pixels, in GIF/JPG format, containing a free representation of the proposed layout.
· 1 text document (in format DOC or RTF) consisting of a maximum of 15,000 characters (approximately 10 typewritten pages) with a description of the project criteria adopted, the proposed solutions, as well as a description of the construction feasibility of the project and the technical-construction choices.

art. 10 - Composition and functioning of the adjudicating bodies

For all three sections of the competition, the Competition Notifying Body appoints a Technical Commission, whose preliminary task will be to check, after the expiration date for delivery of the papers has passed, that the material has arrived on time and in the manner established by the competition notice and that the papers conform to the requirements; this commission will also have a secretarial role in the functioning of the jury.

After the preliminary inspection has been carried out, the Technical Commission will furnish a list of the applicants whose papers were not accepted, with an explanation for their possible exclusion. The Commission will also compile, on the basis of the order of arrival, a list of the participants, in keeping with which the papers received will have to be examined by the jury.

An examining Jury will be appointed for all three sections of the competition. This Jury will have an odd number of members, whose objective will be to examine and evaluate the papers selected and to choose a winner; there will be only one winner, since a 'draw' is not acceptable.

In its composition, the Jury will be made up of a majority of technicians as effective members, with an equal number of supplementary members, made up of expert project designers from the sector, or individuals who have already carried out the role of juror in competitions of equal importance or who have participated in such and have been awarded a prize.

The Jury will be composed of the following seven effective jurors, who will have the right to vote and by the same number of supplementary members:
· 5 effective experts and 5 supplementary members appointed by the Competition Notifying Body;
· 1 effective representative and 1 supplementary member appointed by the National Council of Architects;
· 1 effective representative and 1 supplementary member appointed by the National Council of Engineers.

The meetings of the Jury to decide the winners of the competition will be valid only in the presence of the 7 jurors.

When an effective member is absent, because of circumstances beyond their control or for any other reason (of which the Competition Notifying Body must be informed at least three days prior to the meeting), the position will be forfeited and he or she will be replaced by the corresponding supplementary juror, or, in the event that the latter individual is unavailable, by one of the other supplementary jurors.

A member of the Technical Commission will act as secretary without the right to vote and may be assisted in secretarial duties; this individual will write up the minutes of the meetings and communicate the results, criteria, evaluations and motivations for the choices made to the professional associations for each territory involved.

The president of the Jury will be elected by all the members at the first sitting, from among the effective members appointed by the Competition Notifying Body.

The members of the Jury may not take on - either from the Competition Notifying Body or from whoever takes over its roles after the competition has been completed - roles of planning or consultation for the project that is the subject of the competition, neither individually nor as members of a group.

For their participation in the three sections, each member of the Jury will be paid a single sum to cover their presence and their expense reimbursements. This sum will be Lit. 900,000 or Euro 465 (Lit. 1,800,000 or Euro 930 to jury members whose permanent residence is located at a distance of over 400 km from the site of the competition), gross of withholding tax and net of VAT and social security dues.

The members of the Technical Commission and the Jury, and the respective supplementary members, will be appointed and publicly announced from the date of publication of the competition notice, so that evaluation may be carried out and possible incompatibility may be checked.



art. 11 - Role of the Jury

The Jury, which will be convoked with at least 15 days prior notice, must begin their work at least 10 days before the final date for delivery of papers on the part of competitors.

In the event that it is not possible to meet or in the event that the jury's work is not completed within the established time period, 50% of the total prize money will be distributed in equal parts to all the participants whose inscription has been adjudged correct by the Technical Commission.

Each juror will have one vote and decisions will be reached by a majority of votes; decisions will be incontestable.

The Jury will write a report containing an evaluation of the prize-winning and distinguished ideas; the report will provide reasons for the choice, a description of the methodology used by the commissioners in their evaluation and the sequence of the work carried out. The report will be made public along with the announcement of the winners.

When the final classification list has been drawn up, the Jury will assign the prizes. The first prize may not be assigned at all, in the event that the members of the Jury unanimously decide that there was no project that deserved to achieve that award.

The definitive classification list, the list of all the participants and the concluding report written by the Jury will be made public on the website and sent to the National Councils of Architects and Engineers and to the professional associations in the respective territories.



art. 12 - Result of the competition and prizes

The competition will conclude with a classification listing of merit and the prizes (gross of withholding tax and net of IVA and social security dues) will be assigned as follows:
· one amount of Lit. 3,000,000 (three million lire) or Euro 1,549 to the winning project;
· one amount of Lit. 1,500,000 (one million five hundred thousand lire) or Euro 775 to the second-placed project;
· one amount of Lit. 1,000,000 (one million lire) or Euro 517 to the third-placed project.
The jury will also have the possibility of assigning 10 distinguished entries.



art. 13 - Execution of the work

The Competition Notifying Body, or a contracted agent that may take its place, reserves the right to carry out the construction project that is the subject of the competition.

The members of the Technical Commission and the Jury, and the respective supplementary members, will be appointed and publicly announced from the date of publication of the competition notice, so that evaluation may be carried out and possible incompatibility may be checked.



art. 11 - Role of the Jury

The Jury, which will be convoked with at least 15 days prior notice, must begin their work at least 10 days before the final date for delivery of papers on the part of competitors.

In the event that it is not possible to meet or in the event that the jury's work is not completed within the established time period, 50% of the total prize money will be distributed in equal parts to all the participants whose inscription has been adjudged correct by the Technical Commission.

Each juror will have one vote and decisions will be reached by a majority of votes; decisions will be incontestable.

The Jury will write a report containing an evaluation of the prize-winning and distinguished ideas; the report will provide reasons for the choice, a description of the methodology used by the commissioners in their evaluation and the sequence of the work carried out. The report will be made public along with the announcement of the winners.

When the final classification list has been drawn up, the Jury will assign the prizes. The first prize may not be assigned at all, in the event that the members of the Jury unanimously decide that there was no project that deserved to achieve that award.

The definitive classification list, the list of all the participants and the concluding report written by the Jury will be made public on the website and sent to the National Councils of Architects and Engineers and to the professional associations in the respective territories.



art. 12 - Result of the competition and prizes

The competition will conclude with a classification listing of merit and the prizes (gross of withholding tax and net of IVA and social security dues) will be assigned as follows:
· one amount of Lit. 4,000,000 (four million lire) or Euro 2,066 to the winning project;
· one amount of Lit. 2,000,000 (two million lire) or Euro 1,033 to the second-placed project;
· one amount of Lit. 1,500,000 (one million five hundred thousand lire) or Euro 775 to the third-placed project.
The jury will also have the possibility of assigning 10 distinguished entries.



art. 13 - Execution of the work

The Competition Notifying Body, or a contracted agent that may take its place, reserves the right to carry out the construction project that is the subject of the competition.

In the event that the work is carried out, the role of consultant in the drawing up of the definitive and executive project (or consultation, in the event that structures are used which appertain to the Administration) will anyway be assigned to the author of the winning project. The latter will however have to draw up the project in accordance with the indications and requests of the Competition Notifying Body, who may request the introduction of changes and/or final touches. Such measures will not oblige the organising Body to make further payments above the payments stipulated for the drawing up of such a project.

For the role of consultant in the drawing up of the project a special agreement will be stipulated with the artists. In the event that the winning project has been created by a group, the Competition Notifying Body will make the agreement solely with the person delegated to be group leader, making the payments to him or her that correspond to an individual professional. Any agreements made between the group leader and the other members of the group (or between the members themselves) will be kept separate from the agreements between the Body and the group leader.

The payment amounts will be determined in conformity with professional rates and with the regulations in force when the assignment is made; the 20% reduction allowed by law 155/1989 will be applied to such payment amounts.



art. 14 - Publication of the projects

In a manner and time period to be established, but in any event within 30 days from the proclamation of the competition winners, the projects - organised with the classification proposed by the jury - will be exhibited on the organisation's website. In this site will be displayed all the papers presented and a public forum will be set up to allow for on-line discussion to take place; the authors of the winning and non-winning projects will be invited to take place in this discussion, in order to continue to publicly illustrate their ideas and project proposals.

The participants may request - upon inscription and the sending in of their papers - that their work not be published on the internet. This request will not be accepted by the Competition Notifying Body in the event that the projects in question are among the winners or the distinguished entries. Failure to accept this on the part of the competitors may result in their entries be excluded from the competition.

The Competition Notifying Body reserves the right publish the results of the competition on paper or by other means.



art. 15 - Correctness of the competition notice and disputes

The present competition notice has been drawn up in conformity with the instructions provided by the National Council of Architects and the National Council of Engineers, to whom it was first shown for purposes of approval.

The present competition notice was also published in order to spread awareness of the competition and encourage participation.

Any dispute that may arise regarding the procedures of the competition for the artist section will be entrusted to the evaluation of an arbitration board made up of an expert appointed by the Competition Notifying Body, an expert appointed by the party in question and an expert appointed by the competent court.



art. 16 - Ownership of the proposals

The Competition Notifying Body will have the right to ownership of the winning proposals, while the copyright for each of the projects presented will remain the competitor's possession.

The Competition Notifying Body and the Organising Body, once the papers have been published on the internet (in the site dedicated to the competition and the exhibition), will not be held responsible for any use which third parties may make of such papers and texts.



art. 17 - Use of the projects consigned

The papers will remain on the site dedicated to the competition for one year after the conclusion of the competition itself; this is in order to encourage the debate surrounding the initiative and in order to preserve a record of the project activity.

After the above time period has elapsed, the Competition Notifying Body will have the right to cease displaying the papers on the internet.

The Competition Notifying Body will have the right to use the papers consigned - even after the conclusion of the competition - for the purpose of promoting initiatives, architecture and art as part of the "Scandicci città sperimentale" project.
